Kevon Tyrone Layne must stay out of trouble for the next 12 months if he wants to avoid spending three months in prison.
Magistrate Alison Burke handed down the sentence on the 30-year-old man, who has no fixed place of abode, after he pleaded guilty on Monday to entering Mobile Bites on September 5 with intent to steal.
“I swear I was going to jail yuh,” said Layne as he left the District ‘A’ Magistrates’ Court after the magistrate explained to him what a suspended sentence entailed.
In outlining the facts to the court, Sergeant Kenmore Philip disclosed that while cleaning was being done at the establishment, a food truck, it was discovered that the skylight had been tampered with. Layne, who was recently released from prison, was identified on CCTV footage.
“I came out of prison in April,” Layne told the court. “I sleep in that area, nothing was stolen. I get put out and the rain was falling so I went to get shelter.”
“On the roof?” Magistrate Burke questioned.
Layne replied: “Plus too, I was a little drunk . . . had eight beers. Since I came before the court when I was 14, I never stopped. Eighteen years now I getting locked up but I don’t steal no more.”
He also admitted that he “does anything” to get money including “selling dope”.
